1. Purpose & Scope

This policy sets out the terms governing donation refunds, cancellations, and dispute resolution for Good Planet International Foundation (“GPI”), a charitable organisation established for exclusively charitable purposes under the laws of England and Wales.

This policy applies to all monetary donations received by GPI through any channel, including online platforms, direct bank transfers, cheques, and third-party fundraising platforms.

 

2. Status of Donations

All donations made to GPI are voluntary, unrestricted charitable contributions made to further the Foundation’s charitable objectives. In accordance with UK charity law, once charitable funds are received and allocated, trustees have a legal duty to apply them in furtherance of the charity’s objectives.

By completing a donation, the donor confirms that:

  • The donation is made of their own free will and non refundable
  • The funds become the property of GPI upon receipt.
  • The donation is not made in exchange for goods, services, or guaranteed outcomes.

All donations made to GPI are:

  • Voluntary charitable gifts.
  • Irrevocable upon receipt, subject only to the limited exceptions outlined in Section 3 below.
  • Applied in accordance with the Trustees’ legal duties under the Charities Act 2011.

Once a donation has been received, it becomes the property of the Charity and must be applied by the Trustees solely to further its charitable objectives. Trustees are under a statutory duty to safeguard charitable funds and ensure proper application of assets.

 

3. Refund Policy

As a matter of charity law and trustee duty, donations are non-refundable, except in the following strictly limited circumstances:

3.1 Eligible Exceptions

  • Duplicate payment resulting from a processing error.
  • Administrative error directly attributable to GPI.
  • Demonstrable unauthorised or fraudulent transaction, subject to verification.

3.2 Refund Request Requirements

All refund requests must:

  • Be submitted in writing within 14 calendar days of the original transaction date.
  • Include full transaction details (date, amount, payment method, reference number).
  • Provide reasonable supporting evidence for the claim.

The Board of Trustees reserves sole discretion in determining whether a refund exception applies.

3.3 Non-Refundable Circumstances

Refunds will not be granted for:

  • Change of mind after the donation has been made.
  • Dissatisfaction with charitable activities or programme delivery.
  • Perceived delays in project implementation.
  • Disagreement with campaign messaging or communications.
  • Donations already allocated, committed, or disbursed to charitable programmes.
  • Failure to read or understand published policies prior to donating.

Once funds have been applied or committed to charitable expenditure, they cannot lawfully be returned without breaching trustee duties under the Charities Act 2011.

 

4. Cancellation of Recurring Donations

Donors who have set up recurring or standing donations may cancel future payments at any time by contacting GPI in writing. Cancellation requests apply to future instalments only; payments already processed are governed by the refund policy set out in Section 3 above.

 

5. Chargebacks & Fraudulent Claims

GPI takes all chargebacks and disputed transactions seriously. Donors are strongly encouraged to contact GPI directly before initiating a chargeback with their financial institution.

5.1 Consequences of Unauthorised Chargebacks

Initiating a chargeback without first contacting GPI to seek resolution may:

  • Delay resolution of the matter.
  • Result in submission of full evidentiary documentation to the issuing bank or financial institution.
  • Lead to recovery of chargeback-related administrative costs where legally permissible.
  • Result in restriction of future donation privileges for the individual concerned.

5.2 Evidence Submission

In the event of a disputed transaction or chargeback, GPI reserves the right to submit the following evidence to the relevant financial institution:

  • Evidence of cardholder authorisation and donor consent.
  • IP address logs and session data.
  • AVS/CVV verification results.
  • Confirmation email records and receipts.
  • Acceptance of published terms and conditions.

Knowingly filing a false fraud claim against a registered charity may constitute financial misconduct and could be subject to legal proceedings.

 

6. Payment Processors & Platform Donations

Donations processed through third-party payment providers (including but not limited to PayPal, Stripe, LaunchGood, or similar platforms) are subject to both:

  • The respective provider’s payment processing terms and conditions.
  • This Donation Refund, Cancellation & Dispute Policy.

Where a conflict arises between a third-party platform’s refund terms and this policy, GPI’s policy shall take precedence to the fullest extent permitted by law.

 

 

7. Dispute Resolution

GPI is committed to resolving donation-related disputes fairly and promptly. Donors who wish to raise a concern or dispute should follow the procedure outlined below:

  • Step 1: Contact GPI in writing, providing full details of the transaction and the nature of the dispute.
  • Step 2: GPI will acknowledge the dispute within 5 working days of receipt.
  • Step 3: A formal response will be issued within 14 working days, outlining the decision and any applicable remedies.
  • Step 4: If the donor remains unsatisfied, they may escalate the matter to the Charity Commission for England and Wales.
 

8. Governing Law

This policy and any disputes arising from donations to GPI are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction in relation to any claims or disputes arising under this policy.

GPI reserves full discretion in assessing refund eligibility and by making a donation, the donor acknowledges and agrees to these principles accordingly.
